Investing in Energy
Diversifying into energy can
provide valuable rewards.
Diversifying into energy can provide valuable rewards––for investors seeking to complete a 1031 exchange or for
simple direct investments. High net-worth individuals often turn to energy programs for the potential for
attractive returns as well as tax relief. Tax incentives and O&G investing are generally on a sliding scale:
the more risk involved in the investment, the larger the tax deduction allowance. The IRS provides significant
tax incentives for exploration, drilling, and field reworks, but more minimal deduction allowances for programs
involving the purchase of existing oil and/or natural gas production.

Income Programs
Income partnership funds provide accredited investors access to a diversified pool of cash producing energy
assets. Unlike many energy investments, these funds can be structured to accept monies that have been
previously invested in traditional retirement plans. Income partnership programs generally carry no debt and
are generally not subject to unrelated business taxable income (UBTI).
Rework Programs
In older fields there are often wells that do not perform to full potential or that have additional
reserves “behind the pipe” that have never been tapped. These wells in such fields are often prime candidates
for rework programs. Rework programs attempt to accomplish two things. One, they examine and repair wells
where production has been limited by substandard or inadequate completions, operational constraints, and/or
mechanical problems. Second, they “open up” wells with behind the pipe potential.
Drilling Programs
Drilling programs offer many tax advantages, and these benefits can greatly enhance the overall economics of
an investment. These incentives in the Tax Code exist to encourage capital to go into domestic production of
oil and gas. This makes participation in oil and gas ventures one of the best tax advantaged investment options
available to high net worth investors.
